What Indiana Law Says Must Be Disclosed

Indiana Code IC 5-14-3-5 sets out the minimum information that must be released to the public after a booking. When someone is arrested and taken to the Gibson County Jail, these records are public: the person's name, age, and address; the date, time, and location of the arrest; the name of the arresting officer; the charges filed; and the bail amount. Booking photos are part of this public record in most cases.

The Indiana Public Access Counselor has confirmed this in a published opinion on booking photos and warrants, available at in.gov/pac. If the Gibson County Sheriff's Office refuses to release a booking record or photo that should be public, you can contact the PAC at in.gov/pac/ for guidance or to file a formal complaint.

IC 5-14-3-4 allows some records to be withheld. Records tied to active investigations, ongoing operations, or that could endanger someone's safety may be kept back. Routine completed bookings are not covered by those exceptions and must be disclosed on request.

Court Records for Gibson County Arrests

Indiana Courts provides a free public case search at public.courts.in.gov/mycase/. All criminal cases filed in Gibson County appear in this system. Search by name to see charges, hearing dates, bond conditions, and final outcomes. No account is needed, and there is no fee.

Gibson County Circuit Court and Superior Court handle criminal matters for the county. MyCase covers both. A booking record shows you that someone was arrested. MyCase shows you what happened in court afterward, including whether charges were dismissed, reduced, or resulted in a conviction.

Under IC 10-13-3-27, the Indiana State Police may release limited criminal history information to authorized parties. The ISP Criminal History Services page at in.gov/isp covers how to get a certified records check that includes Gibson County cases.

Expungement of Gibson County Records

Indiana Code IC 35-38-5-5 gives people the ability to petition for expungement of certain arrest and conviction records. Arrests that did not lead to a conviction tend to be the strongest candidates. Convictions may also qualify depending on the offense type and how much time has passed since the case closed. Petitions are filed with Gibson County Circuit Court.

Once an expungement order is entered, official sources are required to restrict access to the record. VINE, MyCase, and the Indiana State Police must all comply. The Gibson County Sheriff's Office must follow the order as well. Third-party sites are slower to reflect expungements, but official government records update to reflect the court order.
